They govern your use of www.igeeksblog.com, our newsletters and related services (the “Services”).
By using the Services you agree to these Terms, our Privacy Policy, our Cookie Policy and our Disclaimer. If you do not agree, please do not use the Services.
You can contact us at info@igeeksblog.com, by phone at +91 98987 73258, or by post at the address above.
Eligibility
You must be at least 13 years old to use the Services. If you are under 18, or under the age of majority where you live, you may use the Services only with the consent and supervision of a parent or guardian, who agrees to these Terms on your behalf. Purchases and accounts require you to be 18 or older, or to have a parent or guardian complete them.
Our content and intellectual property
We own or license all content on the Services, including articles, guides, reviews, images, videos, wallpapers, graphics, code, design and the iGeeksBlog name and logo (the “Content”). The Content is protected by copyright, trademark and other laws in India and other countries.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to view and share links to the Content, and to download or print a copy of individual pages for your own non-commercial use. You may quote short excerpts with a credit and a link to the original article. Any other copying, republishing, translating, selling or commercial use requires our prior written permission, which you can request at info@igeeksblog.com.
Third-party trademarks, including Apple, iPhone, iPad, Mac, Apple Watch and AirPods, belong to their owners and are used for identification only.
Automated access, scraping and AI training
Unless we have agreed otherwise in writing, you may not use bots, scrapers, crawlers or other automated means to copy, collect or index Content, and you may not use Content to train, fine-tune, test or improve any artificial intelligence or machine-learning model, or to build a dataset. This does not apply to standard search engine indexing that follows our robots.txt file.
We expressly reserve our rights to text and data mining of the Content, including under Article 4(3) of EU Directive 2019/790, and signal this reservation in machine-readable form through robots.txt and similar standards.
Accounts
If you create an account, you agree to give accurate information, keep your password confidential and tell us promptly about any unauthorised use. You are responsible for activity on your account. We may change a username that is offensive or impersonates someone else.
Acceptable use
You agree not to:
- break any law or infringe anyone’s rights;
- post or send content that is unlawful, defamatory, harassing, hateful, obscene, sexually explicit, misleading or that harms minors;
- post deepfakes or other synthetically generated audio, images or video that impersonate a real person or are presented as real without a clear label;
- post spam, advertising, affiliate links or fake reviews, or post reviews in exchange for payment without disclosing it;
- upload malware or interfere with the security, servers or networks behind the Services;
- try to bypass paywalls, access controls or rate limits;
- impersonate another person or misrepresent your connection with anyone;
- collect other users’ personal information;
- frame or mirror the Site, or remove copyright or other notices from Content;
- reverse engineer the Services except where the law allows it.
Nothing in these Terms stops you from posting honest reviews of, or comments about, iGeeksBlog anywhere.
Your contributions
If you post comments, reviews, tips or other material (“Contributions”), you keep ownership of them. You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, display, reproduce, edit for length or clarity, translate and distribute your Contributions in connection with the Services and our promotion of them. You confirm that you have the rights needed to grant this licence and that your Contributions follow these Terms.
Ideas, suggestions and feedback you send us may be used without any obligation to you.
We may review, edit, refuse or remove Contributions that we reasonably believe break these Terms or the law. We do not have to monitor Contributions and are not responsible for them.
Third-party links, ads and affiliate offers
The Services contain links to other websites, advertisements and affiliate links. We do not control those sites and are not responsible for their content, products, prices or privacy practices. Any purchase you make from a third party is between you and that seller. See our Disclaimer for details of how we earn money from links.
Copyright complaints
If you believe Content on the Services infringes your copyright, email info@igeeksblog.com with the subject “Copyright Notice” and include: your contact details; a description of the work; the URL of the material; a statement that you believe in good faith the use is not authorised; a statement that the information is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature. We respond to valid notices under the Indian Copyright Act, 1957, the Information Technology Act, 2000 and, where relevant, the US Digital Millennium Copyright Act. Repeat infringers may have their accounts closed.
Suspension and termination
We may suspend or close your access to the Services, or remove your Contributions, if you break these Terms, if the law requires it, or to protect users or the Services. Where reasonable, we will tell you why. You may stop using the Services or close your account at any time. Sections that by their nature should survive termination, such as intellectual property, disclaimers, limits on liability and dispute resolution, will continue to apply.
Changes to the Services and these Terms
We may change, suspend or discontinue any part of the Services. We may update these Terms from time to time. If a change is material, we will post a notice on the Site or email account holders at least 15 days before it takes effect. Continuing to use the Services after the effective date means you accept the updated Terms.
Disclaimer of warranties
The Services and Content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Services will be uninterrupted, error-free or free of harmful components. Our Disclaimer gives more detail.
Limitation of liability
To the fullest extent permitted by law, we and our directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the six months before the claim arose or INR 5,000 (or USD 100). Some jurisdictions do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.
Indemnity
You agree to indemnify us against third-party claims, losses and reasonable legal costs arising from your Contributions, your breach of these Terms or your violation of someone else’s rights. This does not apply to the extent a claim results from our own fault.
Governing law and disputes
These Terms are governed by the laws of India. Before starting any formal proceedings, both parties agree to try to resolve a dispute informally for at least 30 days after written notice to the other party.
If the dispute is not resolved, it will be referred to final and binding arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Ahmedabad, Gujarat, and the proceedings will be in English. Subject to arbitration, the courts at Ahmedabad have exclusive jurisdiction. Either party may seek urgent injunctive relief, or bring claims about intellectual property, in any competent court.
Disputes will be resolved on an individual basis, not as a class or representative action, to the extent permitted by law.
If you are a consumer in the EU, UK or another country whose law gives you the right to bring proceedings in your local courts or to rely on mandatory local consumer protections, nothing in this section removes that right. Indian consumers may also approach the consumer commissions under the Consumer Protection Act, 2019.
California users
If a complaint is not resolved satisfactorily, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.
Electronic communications
You agree that notices, agreements and other communications we send electronically meet any legal requirement that they be in writing.
General
These Terms, together with the policies they refer to, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation, merger or sale. We are not liable for delays caused by events beyond our reasonable control.
Grievance Officer and contact
Complaints about content or these Terms can be sent to our Grievance Officer at info@igeeksblog.com. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.
